AAP leader Sanjay Singh stated on Saturday that the party plans to contact the Rajya Sabha chairman and vice president to request the disqualification of seven MPs who left the party a day prior, labeling their actions as “unconstitutional and illegal”.

“The anti-defection law explicitly prohibits any form of split or faction within the Rajya Sabha and Lok Sabha. Such actions hold no legal standing, even if a two-thirds majority exists,” Singh mentioned during a press conference.

The AAP leader emphasized that neither the anti-defection law nor the Tenth Schedule of the Constitution acknowledges any form of split, breakaway faction, or group in the Rajya Sabha or Lok Sabha, regardless of a two-thirds majority.
He pointed out that this position was also established in the Shiv Sena case and maintained that an increase from seven to eight members would not give any legal legitimacy under the Tenth Schedule.

The seven MPs who declared their intention to join the BJP are entirely “unconstitutional” and “illegal,” he remarked.

“I am drafting a letter to the vice president of India and the chairman of the Rajya Sabha, requesting the disqualification of these seven MPs,” Singh continued.

Additionally, he mentioned that three of these individuals — Raghav Chadha, Sandeep Pathak, and Ashok Mittal — had notably visited the BJP office on Friday, and the party would seek actions concerning the remaining four MPs who were part of the move.

AAP Rajya Sabha MPs Raghav Chadha and Sandeep Pathak announced on Friday their decision to join the BJP along with five other party MPs.

During a press conference, Chadha indicated that seven out of ten Rajya Sabha MPs from AAP are preparing to merge with the BJP.

Senior AAP leader Saurabh Bharadwaj remarked that the party was established by regular karyakartas and continues to be a platform for ordinary workers, noting that many leaders have come and gone.

“The seven MPs who departed had already ceased questioning long ago, so their exit does not affect us. All these conspiracies are intended to undermine the morale of AAP karyakartas, but we will persist in raising questions,” Bharadwaj asserted.

He stated that the BJP is attempting to weaken opposition parties and demoralize AAP workers, but affirmed that party members should remain resilient and continue to ask questions.
