The Court noted that extended litigation would not benefit any party, especially given Rani Kapur’s age. It advised that “this is no age to fight” and emphasized the importance of a peaceful resolution.
The Bench suggested that before moving on to a detailed hearing, the parties should seek reconciliation through dialogue.
The case has been postponed until next week.
The Court has also sent a notice to Priya Kapur, requesting her response to claims that Rani Kapur was removed from the family trust and deprived of her assets.
The dispute involves the late Sunjay Kapur’s widow Priya Kapur, his mother Rani Kapur, and includes family members such as his children from his former marriage to Karisma Kapoor.
The court highlighted that a lengthy inheritance dispute involving an elderly litigant would be counterproductive.
A Bench of Justices JB Pardiwala and Vijay Bishnoi heard the matter and questioned Rani Kapur’s counsel on the reasons for the litigation.
“Why are you all fighting? This is not the age for your client to fight… pursue mediation once and for all, from A to Z. Otherwise, this is a waste,” the court commented.
“You are 80. This is not the age for your client to fight,” it stated, stressing that prolonged litigation has little advantage in such situations.
