The conflict originates from an appeal lodged by MSEDCL before the Appellate Tribunal for Electricity (APTEL) regarding a ruling made by the Maharashtra Electricity Regulatory Commission (MERC) on December 24, 2025.
In its prior ruling, MERC dismissed MSEDCL’s argument concerning the relevance of the Centre’s directive under Section 11 of the Electricity Act, 2003, in relation to JSW Energy’s Ratnagiri unit.

The commission further mandated MSEDCL to pay the tariff according to the power purchase agreement dated February 23, 2010, in addition to the relevant late payment surcharge.
JSW Energy indicated that MSEDCL subsequently approached the Supreme Court through a civil appeal contesting an interim order issued by the Appellate Tribunal for Electricity, which had declined its request to put the MERC order on hold.
The Supreme Court, in its ruling dated April 30, 2026, published on its website on May 5, 2026, resolved the civil appeal. The order instructed MSEDCL to make an interim part payment of ₹250 crore to JSW Energy and requested APTEL to reconsider the interim application presented by MSEDCL.

Shares of JSW Energy Ltd closed at ₹562.00, decreasing by ₹0.65, or 0.12%, on the BSE.
