Lalu Prasad has submitted a petition for the cancellation of the FIR filed by the Central Bureau of Investigation (CBI) and the associated chargesheet regarding the alleged scam. The Delhi High Court reserved its judgment on May 29 after extensive arguments and issued the order on Friday.

In a written ruling released on May 31, the court declined to halt the trial court’s proceedings in this matter. Lalu Prasad had sought to cancel the FIR and chargesheet linked to the alleged scam. The Delhi High Court had previously reserved its judgment on May 29 and delivered its ruling on Friday.
Nonetheless, the court has issued notice regarding Lalu Prasad Yadav’s primary petition, requiring the CBI to respond within six weeks. A further hearing is set for August 12.
Senior Supreme Court attorney Kapil Sibal, representing Lalu Prasad Yadav, argued that the CBI commenced its investigation without the legally required prior approval. He stated that while such approval was secured in other cases, it was notably absent here, thus warranting the quashing of the FIR and chargesheet.
The CBI has charged 78 individuals, asserting that appointments were made in exchange for land transfers. The agency identified 38 individuals as beneficiaries and conducted a thorough investigation. Additionally, on March 6, the CBI filed its third chargesheet in the case, which included Bhola Yadav, a close associate of Lalu Prasad Yadav, as one of the accused.
