DoT Announces New Telecom Regulations, Transitioning from License System to Authorization-Based Framework
On Wednesday (June 24), the Department of Telecommunications (DoT) announced new rules to implement the Telecom Act, 2023, which will replace the previous licensing system with an authorization-based framework.

The new regulations allow current license holders to transition to this updated framework and outline a clear path for operators like Jio, Airtel, and Vi to adapt to the changes.

Additionally, the rules establish a single-window clearance system via the Telecom eServices Portal for obtaining authorizations and facilitating the transition from existing licenses.

The new framework includes a dedicated authorization category for in-flight connectivity, enabling such services to thrive under the new regime.

Telecom operators are mandated to utilize artificial intelligence (AI) and big data analytics to combat fraud. Furthermore, they must implement measures to prevent spoofing and other forms of fraud.

Regarding data localization, the rules specify that entities newly authorized will not be allowed to transfer user data outside of India. The framework also lays a legal foundation for captive non-public networks, enterprise communications, and machine-to-machine (M2M) services.

Under these rules, M2M authorization can be acquired by companies, societies, courts, and government agencies. This provision pertains to machine-to-machine communication services and aims to support applications such as Internet of Things (IoT) deployments, smart meters, and connected vehicles.
