Introducing Pharmacy Law Lowdown, a new podcast offering from Drug Topics®. Hosted by Dae Lee, PharmD, Esq, CPBS and Lucas Morgan, Esq, the podcast will discuss various issues that are impacting independent pharmacies and actionable advice that pharmacists can use to protect themselves and their practice.
Dae and Lucas are both shareholders at Buchanan Ingersoll & Rooney, a national law firm that provides legal, business, regulatory and government relations advice to a wide range of clients. In their work, Dae and Lucas focus on representing independent pharmacies in their dealings against pharmacy benefit managers (PBMs) and other third-party payors such as Medicare and Medicaid.
In the first episode of the podcast, Dae and Lucas discuss PBM enforcement actions, trends in PBM audits, board of pharmacy enforcement actions, how they impact pharmacies across the country, glucagon-like peptide-1 (GLP-1) medication shortages, GLP-1 compounding, how the FDA is conducting inspections, and more.
“Pharmacies [need to be] vigilant and proactive in challenging PBM audit findings that may have what you consider to be initially very small dollar amounts in question,” Lucas said. “The initial perception by a pharmacy could be, ‘Well, this is a very small amount of money. I think I can absorb this loss and if I just play nice with the PBM and take the path of least resistance … then this is all going to go away and everything will be fine.’ The days of that being a way to navigate this relationship and be successful are over.”
