This request is part of a larger lawsuit claiming that the founders have strayed from their initial mission, with a jury trial set to commence later this month.
In a court document, Musk asserted that his lawsuit seeks to “reverse OpenAI’s transition into a for-profit entity and its restructuring.” He contended that this would necessitate leadership changes, including the dismissal of crucial executives.
In response, OpenAI vehemently criticized Musk, labeling the lawsuit as ‘groundless’ and accusing him of attempting to disrupt its operations. In a statement on X, the organization claimed Musk’s legal actions stem from personal and financial motivations rather than any sincere concern for the entity.
The San Francisco-based tech firm stated, “Today, at the eleventh hour, Elon submitted a court filing seeming to alter his stance on attacking the nonprofit OpenAI Foundation.”

OpenAI contended that Musk’s actions are part of a broader strategy to gain leverage and hinder competition in the fast-changing AI landscape.
“The truth is that this case has always been about Elon generating more power and more money for what he wants. Having increasingly realized that his attempt to undermine the nonprofit OpenAI Foundation rests on a baseless legal case, Elon is once again trying to change the narrative and save face as the trial approaches. His lawsuit remains nothing more than a harassment campaign fueled by ego, jealousy, and a desire to impede a competitor,” it stated.
The conflict arises from Musk’s lawsuit against OpenAI and Microsoft, in which he claimed that the company had strayed from its founding principles after receiving significant funding and began planning a restructuring.
In a new escalation, OpenAI has reportedly contacted authorities in California and Delaware, requesting an investigation into what it labeled “improper and anti-competitive behavior” by Musk and his associates. According to Jason Kwon, chief strategy officer at OpenAI, Musk has repeatedly attempted to take control of its nonprofit structure but has failed.
As reported by CNBC, Kwon accused the xAI CEO of trying to undermine the organization through various ‘attacks’ on OpenAI, including “coordinating his efforts” with Meta CEO Mark Zuckerberg.
OpenAI has also indicated that Musk’s actions might be linked to competitive interests, likely favoring his AI venture, xAI, and its platform, Grok.
“These attacks are aimed at shifting control of the future of AGI away from those who are legally bound to ensure that AGI serves all of humanity and placing it in the hands of competitors who lack mission-driven principles and reject any responsibility for safety,” Kwon remarked.
The legal confrontation is poised to escalate ahead of a scheduled trial on April 27, with both parties trading serious accusations.
