ITR Submission: Key Insights on Leave Travel Allowance Regulations, Qualifications, and Exemptions

ITR Submission: Key Insights on Leave Travel Allowance Regulations, Qualifications, and Exemptions
As the July 31 income tax return (ITR) filing deadline approaches, many salaried taxpayers need to review the exemptions in their Form 16 prior to submitting their returns. One notable exemption is Leave Travel Allowance (LTA), which allows qualifying employees to obtain tax relief on specific travel expenses incurred during their leave.

However, LTA is governed by particular conditions under the Income Tax Act. It does not encompass the full cost of a holiday, and not all travel-related expenditures are eligible for this exemption.

Additionally, LTA exemption is applicable solely to taxpayers who select the old tax regime. Those opting for the new tax regime are not entitled to claim the LTA exemption.
What is Leave Travel Allowance?

Leave Travel Allowance (LTA), often referred to as Leave Travel Concession (LTC), is an allowance granted by employers to employees to cover travel expenses incurred during leave.

According to Section 10(5) of the Income Tax Act, in conjunction with Rule 2B of the Income Tax Rules, the allowance can be exempt from taxation if the specified conditions are fulfilled.

Who can claim LTA?

The exemption is reserved for salaried employees who receive LTA as part of their salary structure. Employees without this component in their salary package typically cannot avail of the exemption. The travel must also take place while the employee is on leave.

What expenses are eligible for the exemption?

LTA only covers the actual cost of travel within India. Depending on the journey, the exemption may apply to airfare, rail fare, or public transport fare, subject to limits set by the regulations. This exemption is confined to travel expenses and does not include other vacation-related costs.

What expenses are excluded?

Costs for hotel stays, meals, local sightseeing, shopping, and other incidental expenses are not eligible for the exemption. Furthermore, travel outside India does not qualify, as the tax benefit is restricted to trips taken within the country.

How frequently can the exemption be claimed?

The Income Tax Rules permit employees to claim the exemption for two trips in a block of four calendar years as defined by the government. If only one trip is claimed within a block, the unused exemption can be carried forward and applied to the first trip in the subsequent block, subject to relevant conditions.

Can the exemption be claimed for family travel?

The benefit may extend to travel undertaken by eligible family members, provided that the conditions outlined in the Income Tax Rules are met. The exemption is subject to the defined concept of ‘family’ and other applicable limits.

Are travel documents necessary?

Taxpayers should keep travel tickets, boarding passes, and other related documents to validate their travel. Employers may require these documents prior to granting the exemption, and taxpayers should safeguard them in case they are needed for tax inspection or verification.

Can you claim LTA while filing your ITR?

If the employer has already accounted for the exemption after verifying the necessary documents, it will usually be indicated in Form 16. Taxpayers should double-check these details before filing their returns. Those intending to claim the exemption directly on their ITR should ensure they adhere to all specified conditions and have sufficient documentation to support their claims.
