US Appeals Court Temporarily Halts Decision on Trump’s 10% Worldwide Tariffs

On Tuesday, a U.S. appeals court temporarily suspended a lower court decision that challenged the Trump administration’s 10% global tariff under Section 122 of the Trade Act. This decision allows the tariffs to remain in effect for three importers who had recently received relief from the duties.

• The U.S. trade court ruled against the implementation of the new tariffs on Friday, however, it did not completely prevent their enforcement.

• The Trump administration has since filed an appeal.
• As the ruling is on hold, tariffs will be reinstated for the two businesses and Washington state, which filed a lawsuit regarding the tariffs.

• The U.S. Court of Appeals for the Federal Circuit has issued a temporary administrative stay while considering a more extended suspension of the lower court ruling.

• Washington is regarded as an importer due to its tariff payments made through the University of Washington, a public research institution.

• The businesses and Washington state have seven days to contest a prolonged pause on the lower court’s decision that favored them.

• The 10% global tariff was introduced in February following the U.S. Supreme Court’s decision to annul most tariffs enacted by Trump in 2025.

• This global tariff is set to lapse in July unless Congress decides to extend it.

• The most recent global tariffs were instituted under Section 122 of the Trade Act of 1974.
